Vocabyx Terms and Conditions

1. Acceptance of Terms

These Terms and Conditions form a binding agreement between you and the developer of Vocabyx, an independent developer operating as a private entrepreneur in Ukraine. By downloading, accessing, or using the Vocabyx mobile application, you agree to be bound by these Terms.

If you do not agree, please do not use the App.

You must be at least 13 years old, or the minimum age of digital consent in your country, to create an account and use the App. By using the App, you represent that you meet this requirement.

2. Description of Service

Vocabyx is a vocabulary-learning application that allows users to study flashcard-based vocabulary decks ("dictionaries") across multiple languages.

Users may browse and study decks created by other users from a shared catalog, and may create and optionally share their own decks for other users to discover and study.

We may add, modify, or remove features of the App at any time, including the future introduction of optional paid subscriptions or in-app purchases, at our sole discretion.

3. Accounts

• You must register using a valid email address and a password to access most features of the App.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate information when creating your account and to keep it up to date.
• You must notify us promptly if you become aware of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe to be fraudulent, abusive, or harmful to the App or other users.

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to the App, other users' accounts, or our systems.
• Reverse engineer, decompile, or disassemble the App, except to the extent permitted by applicable law.
• Use automated means, including bots or scrapers, to access or extract data from the App without our prior written consent.
• Interfere with or disrupt the integrity or performance of the App.
• Upload viruses or other malicious code.

6. Intellectual Property

The App itself, including its design, software, graphics, logos, and trademarks, excluding User Content, is owned by the Developer and is protected by applicable intellectual property laws.

Except for the rights expressly granted to you in these Terms, no other rights are granted to you in the App or any of its content.

7. Subscriptions and Purchases

As of the date of these Terms, Vocabyx is offered free of charge. We reserve the right to introduce optional paid features, subscriptions, or in-app purchases in the future.

If we do so, pricing and billing will be processed through the Apple App Store and or Google Play in accordance with their respective terms and payment systems.

Subscription terms, renewal, and cancellation will be governed by the applicable app store's policies, and we will update these Terms and notify users of material changes before such features go live.

8. Third-Party Services

The App may rely on third-party services, such as cloud hosting, authentication providers, or analytics tools, to operate.

We are not responsible for the availability, content, or practices of these third-party services beyond our reasonable control.

9. Disclaimers

The App is provided as is and as available, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the App will be uninterrupted, error-free, or secure.

We do not guarantee the accuracy, completeness, or reliability of any User Content, including vocabulary decks created by other users. You use such content at your own discretion.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of, or inability to use, the App, even if advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including for fraud or gross negligence.

11. Termination

You may stop using the App and delete your account at any time through the App's settings.

We may suspend or terminate your access to the App, with or without notice, if we believe you have violated these Terms or for any other reason at our reasonable discretion, including discontinuing the App entirely.

Upon termination, your right to use the App will immediately cease. Sections of these Terms that by their nature should survive termination will survive.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law principles, except where mandatory consumer protection laws of your country of residence provide otherwise.

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts, subject to any mandatory rights you may have under the law of your country of residence.

13. Changes to These Terms

We may update these Terms from time to time, including to reflect new features such as subscriptions.

We will notify users of material changes through the App or by other reasonable means and update the last updated date above. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
